Dorsey and Semrau successfully defends, on behalf of the Morris County Municipal Joint Insurance Fund, a late Notice of Tort Claim filed against Rockaway Township
On May 22, 2025, the Appellate Division upheld a trial court decision in Morris County Superior Court dismissing a late Notice of Tort Claim filed against Rockaway Township in connection with a slip and fall injury. The trial court and the Appellate Division carefully evaluated the extraordinary circumstances standard required for a plaintiff to obtain court permission to file a Notice of Tort Claim outside the 90-day deadline, and agreed that the standard was not met here.
