Jonathan Testa is a graduate of Western Michigan University Cooley Law School, where he received the 2008 Distinguished Student Award, honoring students displaying high standards throughout their law school careers. He is admitted to practice in the States of New Jersey and New York, as well as the Federal District Court for the District of New Jersey and the Third Circuit Court of Appeals.
Upon graduating from law school, Mr. Testa entered private practice, where he has been primarily engaged in all aspects of civil litigation insurance defense from the beginning of litigation through trial. He has appeared and successfully argued cases before both the New Jersey and Third Circuit Courts of Appeals, including issues related the compensability of occupational diseases under N.J.S.A. 34:15-31 of the New Jersey Workers’ Compensation Law; application of the immunities under the Tort Claims Act, N.J.S.A. 59:1-1 et seq; abandonment of nonconforming uses under the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq.; and the statutory application of the Child Sexual Abuse Act, N.J.S.A. 2A:61B-1 to public schools.
For last six-plus years, Mr. Testa has practiced as assistant municipal attorney and special counsel for several local and county government entities. In this role, Mr. Testa has served as lead defense counsel for county correctional institutions and high-ranking elected and appointed government officials. This work has allowed Mr. Testa to gain significant legal experience in the defense of civil rights, personal injury, contractual, and property damage claims brought under 42 U.S.C. §1983, the New Jersey Civil Rights Act and Law Against Discrimination, Titles 59 and 39, as well as the Consumer Fraud Act.
Contemporaneously, Mr. Testa has provided on-call legal assistance to local government officials on a daily basis. Through Mr. Testa’s guidance, government institutions have developed and refined internal policies and procedures for proactive loss prevention and discovery preservation, which has led to decreases in legal exposure and litigation.
